This Software License Agreement (this “Agreement”) is inbetween you (either an individual or an entity, referred to hereinafter as “you” or “your”) and ModenaCam, and its affiliates (“ModenaCam”, “we”, “our” or “us”) for the ModenaCam software that accompanies this Agreement, as may be updated or substituted by feature enhancements, software updates or maintenance releases (the “Software”) and any services that may be provided by ModenaCam under this Agreement (“Services”). Do not use the Software until you have cautiously read the following Agreement.В
This license is granted to You alone. You may not redistribute the Software in entire or in part. You may not rent, lease, sublicense, sell, assign, pledge, transfer or otherwise dispose of the Software in any form, on a makeshift or permanent basis, without the prior written consent of ModenaCam.В
You may not use the Software to engage in or permit others to engage in any illegal activity where the Software is accessed and used. You may not use the Software to engage in any activity that will crack the rights of third parties, including, without limitation, through the use, public display, public spectacle, reproduction, distribution, or modification of communications or materials that infringe copyrights, trademarks, publicity rights, privacy rights, other proprietary rights, or rights against defamation of third parties.В
You are limited to three (three) licensed URL switches or updates.В

By using and/or purchasing ModenaCam services/package you read, understand and agree the following terms:
1. Hours of Operation
Our hours of operation are Monday-Friday 9AM-6PM GMT+Two excepting legal holidays. Telephone assistance is only available during business hours. While we response support tickets during off hours certain types of requests such as billing, customer service, and advanced support are examples of issues that may require advanced services only available during business hours.
Two. ModenaCam Hosted Emergency SupportВ
We reaction general sales and technical support questions during normal business hours. If you are a ModenaCam Hosted customer and your site is offline after hours at any time you can submit an emergency support request which will instantly page our after-hours techs.
Trio. Telephone Assistance
Not all ModenaCam software or services include phone support. Please be sure to check your purchase description to see if phone support is included.
Four. Ticket Responses and Support
We ensure one ticket reply within three business days.
You can always view your existing tickets to see the progress of your request or what department your ticket has been assigned to. After a ticket has existed for seventy two hours, you may use the management escalation feature to tag your ticket for management review if the issue is not being resolved decently. Billing, customer service, and special requests will only be answered during normal business hours.
ModenaCam does not assume responsibility for any issues that may arise as consequences of any modifications made to the product by the user following the installation of the ModenaCam product.
In some circumstances server-level issues will influence our software’s capability to execute decently. ModenaCam cannot make adjustments to your server hosting environment to bring it within the normal environment most hosting providers use.
Our staff will often need access to your community admin area or server file system to diagnose a support issue. If you cannot or will not provide such access: support will be limited or unavailable.
Five. Disclaimers and Limitation of Liability
You understand and agree that this Site is provided "AS-IS" and that we assume no responsibility for your capability to (or any costs or fees associated with your capability to) obtain access to ModenaCam. Nor do we assume any liability for the failure to store or maintain any user communications or private settings.

* The license for your installation is only yours for as long as your lease is active.
ModenaCam is a software product, no warranties are applied and no refunds are suggested.
11. Software Delivery
You will receive the zip archive containing all the files or the service activation within seventy two hours from your order, depending on the package you ordered.
PHP, MySQL and HTML coding is Open source, but the talk/AMS components are compiled and switch sides engineering is prohibited.
We suggest no uptime, speed or data safety assures. We cannot be held liable for any harm a downtime or data loss has caused to your company.
13. Software Support
We assure at least one reply within three business days.
Attacking, threating or acting in an inappropiate manner towards ModenaCam staff will result in immediat license and service cancellation without notice or refunds.
You may not engage in illegal, abusive, or irresponsible behavior. ModenaCam reserves the right to terminate service of any customer without refund for such behvior including:
* Monitoring data or traffic on any network or system without the authorization of the proprietor of the system or network.

* Use of an Internet account or computer without the proprietor’s authorization, including, but not limited to Internet scanning (tricking other people into releasing their passwords), password robbery, security slot scanning, and port scanning.
* Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting; or
* Any conduct that is likely to result in retaliation against the ModenaCam’s network.
* Use of ModenaCam’s network in a way that unreasonably interferes with ModenaCam’s other customers use of the network.
* Attack, make threats or act in an inappropiate manner towards ModenaCam staff.
* Sending out of spam, storing illegal content or any kind of illegal activities conducted on our servers.

11. Software Delivery
You will receive the zip archive containing all the files or the service activation within seventy two hours from your order, depending on the package you ordered.
PHP, MySQL and HTML coding is Open source, but the talk/AMS components are compiled and switch sides engineering is prohibited.
We suggest no uptime, speed or data safety assures. We cannot be held liable for any harm a downtime or data loss has caused to your company.
13. Software Support
We assure at least one reply within three business days.
Attacking, threating or acting in an inappropiate manner towards ModenaCam staff will result in immediat license and service cancellation without notice or refunds.
You may not engage in illegal, abusive, or irresponsible behavior. ModenaCam reserves the right to terminate service of any customer without refund for such behvior including:
* Monitoring data or traffic on any network or system without the authorization of the proprietor of the system or network.
* Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overcharge a system and broadcast attacks.
* Use of an Internet account or computer without the proprietor’s authorization, including, but not limited to Internet scanning (tricking other people into releasing their passwords), password robbery, security slot scanning, and port scanning.
* Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting; or
* Any conduct that is likely to result in retaliation against the ModenaCam’s network.
* Use of ModenaCam’s network in a way that unreasonably interferes with ModenaCam’s other customers use of the network.
* Attack, make threats or act in an inappropiate manner towards ModenaCam staff.
* Sending out of spam, storing illegal content or any kind of illegal activities conducted on our servers.
